A mother from South Carolina is suing the toy company Mattel, claiming “emotional distress” after her minor daughter accidentally accessed a graphic adult entertainment website due to a misprint on the packaging for dolls inspired by the “Wicked” movie.
In a proposed class-action lawsuit filed in federal court in Los Angeles on December 3rd., Holly Ricketson stated that she purchased a Wicked doll for her daughter. The doll included a link to an adult entertainment website. When her daughter visited the site, she showed Ricketson explicit photographs from it, and both were “horrified” by what they saw, resulting in emotional distress.
“If plaintiff had been aware of such an inappropriate defect in the product, she would not have purchased it.” the lawsuit states.
The documents claimed that although Mattel recalled the products on Nov. 11th, it did not offer refunds to customers who purchased the dolls.
According to The People, Tuesday’s lawsuit demands at least $5 million in damages for consumers in the United States who purchased Wicked dolls that featured packaging linking to the adult entertainment website.
It accuses Mattel of negligence, selling products unfit for sale, and violating California consumer-protection laws.
