A Marine veteran and former firefighter is facing permanent brain damage after allegedly becoming critically ill from contaminated raw oysters served at a well-known Chicago-area steakhouse, according to a lawsuit.
According to WGN News, Joe Belgio, 44, reportedly ate the oysters while dining with his family at Gibsons Bar & Steakhouse in Oak Brook on June 30, 2025. Days later, Belgio became severely ill and had suffered cardiac arrests, causing him to lose consciousness and oxygen for several minutes.
He was revived by firefighters from the Cicero Fire Department, where he previously worked, and hospitalized. According to his attorney, Belgio remained in a coma for months and has now been left with severe cognitive impairments.
The lawsuit alleges medical testing identified pathogens associated with contaminated shellfish, including Enteropathogenic E. coli and Plesiomonas shigelloides. Doctors reportedly determined the illnesses were connected to the oysters, according to the complaint. They say Belgio had consumed no other raw seafood between the meal and his hospitalization.
Belgio remains hospitalized and requires around-the-clock care. His attorney said he is likely to remain bedridden and require lifelong assistance because of the extent of his brain injuries.
The lawsuit names Gibsons Bar & Steakhouse and seafood distributor Supreme Lobster and Seafood Company as defendants. Belgio is seeking $50,000 in damages, in addition to coverage for his ongoing medical expenses.
Gibsons has denied responsibility, telling WGN News that there were no other reported cases of illness and that its internal investigation found no evidence that the restaurant caused Belgio’s condition.
Belgio’s family says the incident has drastically changed his life. He and his fiancée, Melanie Stayer, had recently welcomed their daughter when the family meal took place.
The lawsuit remains ongoing as Belgio’s family seeks compensation and the support for the extensive care he is expected to need moving forward.
